Terms of Service
These Terms govern the engagement between you and Fotografest Marketing LLC ("Türkiye FotoShoot", "we", "us", "our") when you commission photography or videography services or use the turkiyefotoshoot.com website. The contractual relationship for any shoot is established by a signed proposal or written statement of work; these Terms apply to the website and to any engagement where a separate signed contract is silent.
1. Engagement model
Türkiye FotoShoot is a corporate photography and videography studio. Every commission begins with a written brief and a line-item quote. A commission is binding once you (or an authorised representative) countersign the proposal and the deposit invoice has been issued.
2. Quotes and pricing
Quotes are valid for 30 calendar days from issue. Prices are net of Turkish KDV (VAT) where applicable, which is added at the rate in force on the invoice date.
Out-of-scope additions requested during the engagement (additional crew, extra coverage days, additional deliverables, third-party licences) are confirmed in writing and added as a contract amendment before work begins on them.
3. Payment terms
Standard payment terms are a 35% deposit on countersignature of the proposal to secure the event date. The remaining balance is paid on the event day or up to two business days before the event. Bank transfer and card payments are both accepted. POs are accepted; the invoice references the PO number where one is provided.
Late payments accrue statutory interest at the rate set by Turkish commercial law. We retain a lien over delivered files until cleared payment is received.
4. Rescheduling and cancellation
We understand corporate calendars move. To reflect that, the policy is:
- More than 14 days before the agreed shoot date: reschedule at no charge. The deposit transfers to the new date within 12 months.
- Between 14 and 7 days before the shoot: reschedule with a 25% rebooking fee against the deposit, or cancel with the deposit retained.
- Within 7 days of the shoot: cancellation forfeits the full deposit. Rescheduling is on a best-efforts basis subject to team availability and is invoiced at the new date’s rate.
- Force majeure (government action, venue cancellation outside your control, certified medical, severe weather grounding aerial work, etc.) is handled in favour of the client: the deposit is held against a future date with no fees.
Studio-side cancellation (illness, equipment failure we cannot mitigate with the backup we hold, restricted-airspace denial we could not foresee) refunds the deposit in full and, where reasonably possible, includes a referral to a peer studio.
5. Deliverables, originals and RAW files
Every original photograph captured during the engagement is delivered to you in a secure private gallery within 24 hours of the event. Retouched selects follow within five business days, in five aspect ratios per subject for portrait work. Edited video deliverables follow within up to seven business days. RAW photo files and unedited video footage are available on request for an additional fee disclosed in the quote.
Deliverables are sized and formatted per the brief. Versions beyond the contracted format set are quoted separately.
6. Licensing and intellectual property
Original copyright in the photographs and video remains with Türkiye FotoShoot. On full payment, we grant the client a perpetual, worldwide, royalty-free, non-exclusive licence to use the delivered files for the purposes set out in the brief: corporate communications, marketing, investor relations, press releases, internal use. Resale to third parties, stock-image syndication, and AI training data licensing are explicitly excluded from the standard licence and require a separate written agreement.
Credit is appreciated but not contractually required. We may use frames from the engagement in our portfolio and proposals where the client has not requested otherwise in writing.
7. Team safety, insurance and site protocols
The studio carries professional indemnity and public liability insurance. Teams working on industrial sites carry their own PPE and follow your HSE induction; ATEX-rated lighting and intrinsically safe equipment are available for hazardous-area work, quoted separately. Aerial work is operated under valid SHGM licences and within the airspace clearance issued for the date and location of the shoot.
8. Limitation of liability
The studio’s aggregate liability for any claim arising out of an engagement is limited to the contract value paid by the client for that engagement. We do not accept liability for indirect, consequential, special or punitive damages, including loss of revenue, loss of business opportunity, or third-party claims. Nothing in these Terms limits liability for gross negligence, wilful misconduct, or any liability that cannot lawfully be excluded under Turkish law.
9. Governing law and disputes
These Terms and any engagement entered into under them are governed by the laws of the Republic of Türkiye. The Istanbul Çağlayan Courts and Enforcement Offices have exclusive jurisdiction for any dispute arising out of these Terms, without prejudice to the parties’ option to resolve disputes by good-faith negotiation or by mediation before a senior officer of each party.
10. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates the current version. Engagements in progress at the time of an update remain governed by the version in force at the date of the signed proposal.
